Senate Republicans have released a revised draft of the proposed Crypto Clarity Act, reigniting debate in Washington over cryptocurrency regulation, ethics and investor protection. The updated legislation aims to establish a clearer legal framework for the digital asset industry, but it has already drawn strong criticism from Senate Democrats.
Senator Elizabeth Warren, the ranking member of the Senate Banking, Housing and Urban Affairs Committee, argued that the latest version of the bill contains significant loopholes and fails to address potential conflicts of interest involving President Donald Trump’s cryptocurrency ventures.
According to Warren, the proposed legislation does not adequately prevent a sitting president from profiting from cryptocurrency businesses while in office. She also questioned the bill’s enforcement provisions, claiming they rely primarily on the Department of Justice while limiting the ability of state attorneys general and private parties to pursue legal action. Warren further argued that the draft includes provisions that could restrict future enforcement after a president leaves office.
The Senate Banking Committee’s Democratic minority staff also released an analysis of the revised bill, alleging that the proposed ethics measures would not effectively prevent public officials from benefiting financially through indirect ownership structures, licensing agreements or affiliated entities involved in cryptocurrency projects.
The analysis references President Trump’s financial disclosures, which reportedly show substantial earnings from cryptocurrency-related ventures, including digital tokens, stablecoins and other blockchain-based assets. Democratic lawmakers argue that the bill, as currently drafted, would still allow existing ventures using the president’s name or likeness to continue operating without violating its ethics provisions.
Republican supporters of the legislation, however, have maintained that the Crypto Clarity Act is designed to provide long-awaited regulatory certainty for the rapidly growing digital asset industry. They argue that establishing clear rules for cryptocurrency markets will encourage innovation, strengthen investor confidence and improve the United States’ competitiveness in the global digital economy.
The revised bill is expected to face intense debate in Congress as lawmakers continue to negotiate the balance between fostering innovation in the cryptocurrency sector and strengthening oversight, consumer protection and ethical safeguards for public officials.
